FanPort Acceptable Use Policy

This Acceptable Use Policy ("Policy" or "AUP") outlines the standards of conduct required for all users of the FanPort platform (operated by Success Co., Ltd. (サクセス株式会社)), whether they are Creators, Fans, or otherwise interact with the Platform. It governs what is and is not permitted on FanPort, including the uploading, posting, displaying, and sharing of content and all other behaviour while using the Platform.

This Policy supplements the Terms of Service and other applicable FanPort policies. In the event of a conflict between this Policy and the Terms of Service, the terms of this Policy shall prevail for the specific subject matter it governs.

Definitions

  • "Creator" means a User who publishes content on the Platform and makes it available to Fans.
  • "Fan" means a User who accesses Creator content and makes payments on the Platform.
  • "Prohibited Content" means any content that violates the rules set out in this Policy.
  • "Platform" means the FanPort website and all related services operated at fanport.co.

1. General Use

All Users must only access FanPort for lawful, personal purposes and in accordance with this Policy. Users must not:

  1. Sell, rent, share, or transfer their account or any content obtained via FanPort to any other person;
  2. Attempt to bypass any security or access restrictions on the Platform;
  3. Create a false identity, pose as another person or entity, or otherwise deceive other Users;
  4. Engage in stalking, bullying, harassment, intimidation, or any threatening conduct directed at another person;
  5. Promote, spread, or participate in hate speech of any kind, including content designed to demean or incite hostility toward groups defined by race, ethnicity, religion, gender, sexual orientation, or similar characteristics;
  6. Engage in disruptive platform behaviour including spamming, flooding, or trolling;
  7. Use FanPort for any illegal, fraudulent, or unauthorised purpose.

Users who are under the age of 18, or who are required by law to register as sex offenders, are strictly prohibited from using the Platform.

FanPort may suspend or terminate access for any breach of this Policy.

2. Content Restrictions

2.1 General Conduct

Users must not upload, share, display, or promote:

  1. Content that is illegal, fraudulent, misleading, or that encourages violence or criminal acts;
  2. Content featuring, involving, encouraging, or referencing the exploitation or abuse of anyone under the age of 18;
  3. Content that the User does not own or does not have legal rights to distribute.

2.2 Zero-Tolerance Prohibited Content

The following content is strictly prohibited under all circumstances. FanPort applies a zero-tolerance policy and will take immediate action upon discovery, including reporting to law enforcement authorities:

  1. Child Sexual Abuse Material (CSAM) or any content that sexualises minors in any way;
  2. Any content depicting persons under the age of 18, or appearing to be under the age of 18, engaged in sexual activity;
  3. Non-consensual sexual content, including "revenge porn" or intimate images shared without the explicit prior consent of all individuals depicted;
  4. Content depicting, advertising, promoting, or referring to human trafficking, forced prostitution, or escort services — whether explicitly or through the use of slang, symbols, acronyms, or abbreviations;
  5. Content depicting bestiality, necrophilia, extreme sexual violence, or other acts that are illegal under applicable law;
  6. Content that promotes or glorifies suicide or self-harm;
  7. Content that promotes the use, manufacture, or sale of illegal drugs;
  8. Content that advertises or promotes the illegal sale, possession, or use of firearms or other regulated goods.

2.3 Sexual and Explicit Content

Where adult content is posted by Creators within the boundaries set by the Terms of Service, the following types of content remain strictly off-limits under all circumstances:

  1. Any material depicting, or reasonably suggesting, a participant under 18 years of age, including content that uses language implying youth or near-underage status (for example, phrases referencing being "freshly adult" or "technically of age");
  2. Content recorded or broadcast in any location where bystanders could reasonably be exposed to the activity without having chosen to do so;
  3. Content involving any individual who has not granted clear, voluntary, and fully informed advance consent to both the capture and the publication of such material;
  4. Any material in which a participant's identity cannot be confirmed because their face is hidden — whether by a mask, garment, or other means — except where the content is unambiguously presented as AI-generated.

2.4 Hate Speech, Harassment, and Discrimination

  1. Publishing material that promotes hatred, discrimination, or violence targeting individuals or groups on the basis of characteristics such as race, ethnic background, country of origin, faith, gender identity, sex, sexual orientation, age, disability, or any other protected attribute;
  2. Sending unsolicited sexual messages or content that treats another User or third party as a sexual object without their agreement;
  3. Producing or sharing AI-generated or otherwise fabricated sexual imagery of real people without their knowledge and explicit approval;
  4. Behaving in any way that a reasonable person would consider threatening, abusive, offensive, or designed to cause distress to others.

2.5 Privacy and Personal Data

Users must not disclose personal information belonging to any other person unless that person has given express written permission. This covers, but is not limited to:

  • Real names, official identity documents, phone numbers, physical addresses, financial account details, or health-related information;
  • Personally Identifiable Information (PII) — for example, email addresses, home addresses, or government ID numbers;
  • Information gathered through automated collection tools or taken from non-public databases;
  • Direct messages or private conversations between individuals.

2.6 Content Authenticity and Quality

Content shared on FanPort must be:

  1. Originated by the Creator themselves, or by collaborators operating under their express approval;
  2. Truthful and presented in good faith — not designed to mislead, generate spam, or artificially boost platform metrics;
  3. Clearly disclosed as AI-generated or synthetic if produced using AI or automated tools.

2.7 Public-Facing Media Standards

All profile images, banners, and any material viewable by non-subscribers must be appropriate for a general audience and must not include:

  1. Nudity or content that implies nudity;
  2. Sexually provocative posing, graphic sexual language, or pornographic framing;
  3. Language intended to suggest the Creator is barely or newly of legal age (e.g. phrases referencing "just turned adult" or similar);
  4. AI-generated content presented without a clear disclosure to that effect.

3. Off-Platform Conduct

Users must not solicit other Users to engage in transactions outside of the FanPort platform in order to circumvent the Company's fees. Such conduct constitutes a breach of the Terms of Service and may result in account termination.

4. Security and Technical Constraints

Users must not:

  1. Circumvent, disable, or interfere with any security-related features of the Platform;
  2. Send an excessive volume of requests to FanPort's servers beyond what a human user could reasonably generate;
  3. Introduce viruses, trojans, worms, logic bombs, or other malicious or technically harmful material;
  4. Use automated programs, bots, spiders, or scraping tools to access the Platform or extract content without authorisation;
  5. Decompile, disassemble, or reverse engineer any part of the Platform except where expressly permitted by applicable law;
  6. Use proxy servers, VPNs, or other anonymising technologies to circumvent region-specific restrictions, safety measures, or compliance controls.

5. Intellectual Property

  1. Copy, capture, redistribute, or otherwise make available any Creator content without explicit permission to do so;
  2. Pose as FanPort, any member of its team, another User, or any other individual or organisation;
  3. Register using someone else's details or gain access to another person's account or content without authorisation;
  4. Engage in any activity that infringes intellectual property rights — including copyright, trademarks, personality rights, or data protection rights — belonging to FanPort or any third party.

6. Breach Consequences

FanPort reserves the right to:

  1. Suspend or terminate accounts for any violation of this Policy;
  2. Withhold or reduce Creator or User account balances, in whole or in part, and restrict withdrawal access where a policy violation has been determined;
  3. Report criminal activity, including CSAM and human trafficking, to relevant law enforcement agencies and organisations such as the National Center for Missing and Exploited Children (NCMEC);
  4. Pursue civil or criminal legal action where appropriate.
